Architectural Rules and Regulations

The following Rules and Regulations were established and adopted in accordance with Article 7 of The Villages of Wisp Declaration of Covenants, Conditions, and Restrictions.

1. EXTERIOR PAINTING AND ROOFING

a. All units within a building must act concurrently. (Please see additional procedures at bottom of page)

b. The type of stain, paint, or preservative used on the siding, trim, or deck areas shall be only those products identified under the VOW Exterior Paint Specifications. (See Attached Specifications).

c. Down spouts and gutters must be painted the same color as the unit's trim.

d. Decks and patios must be preserved and maintained in their original states.

e. All exterior painting and/or roofing plans must be approved by the Architectural Committee.

2. CHANGES, ADDITIONS, AND ALTERATIONS

a. All external changes, additions, and alterations must be approved by the Architectural committee in accordance with the guidelines contained in Article 7 of the Declaration of Covenants, Conditions, and Restrictions.

MOST COMMON (but not limited to) CHANGES NEEDING APPROVAL ARE:
· Patios, Decks, and Walkways
· Fences and Walls
· Hot Tubs and Spas
· Storm/Screen Doors -

· Any Projects Needing County Permit

b. The Application for Architectural Change Form, with Plans and Specifications, must be submitted by the homeowner to the Architectural Committee. The committee will review the proposal and act in accordance with the guidelines of Article 7 of the Declaration of Covenants, Conditions, and Restrictions.

3. LANDSCAPING

a. It is the owner's responsibility to maintain his lot in good order and repair. This includes seeding and watering lawns, maintaining and repairing walkways, and pruning all trees and shrubs.

b. Replacement of "like and kind" plants, shrubs, and trees does not require Architectural Committee approval; however, any additions or changes to existing landscaping schemes must be approved.

c. All plantings must be similar in height and size to the current landscaping profile.


4. MISCELLANEOUS REGULATIONS

a. All firewood must be stored on the side or in the rear of the unit and should be stacked at least 12 inches from exterior walls of buildings.

b. No picnic tables, lawn furniture, grills, playground equipment, etc. should be placed or stored in the front or side of any unit.

c. No sign should be erected, posted, or displayed in front or about any lot or unit. This includes "For Sale", "For Rent", "No Parking", and political signs.

d. No outside television antenna or radio antenna should be installed on any unit or lot. Satellite dishes will be considered following completion of the Application for Architectural Change form and approval by the Architectural Committee.

PROCEDURES FOR SUBMITTING APPLICATIONS FOR ARCHITECTURAL CHANGES


1. Owners wishing to make any changes, additions, or alterations to their homes or lots must submit an Application for Architectural Change Form with all appropriate sections completed. Be sure to include dimensions, color schemes, type of materials, and design information. For landscaping, include type of plans and any topographical changes. Show details by attaching drawings, photographs, catalog instructions, etc. If needed, attach a survey of your lot showing the locations of the proposed change(s).

2. Please submit the application, plans, and specifications. Upon approval by the Architectural Committee, one copy will be retained by the Committee and another, bearing approval of the Committee in writing, will be returned to the applicant.

4. The Architectural Committee will try to review and respond to applications within 15-to-30 days from receipt of the application. The Declaration of Covenants, Conditions, and Restrictions require the Committee to respond within 60 days.

5. If a proposal is rejected, the reason(s) for disapproval will be stated as part of the written decision. The applicant may request reconsideration if new or additional information, which might clarify the request or demonstrate its acceptability, can be provided.

6. Approval of any project by the Architectural Committee does not waive the necessity of obtaining the required governmental permits.

7. The Committee will not knowingly approve a project that is in violation of the local Building or Zoning Codes. The burden of determining whether an application is in violation of the local Building or Zoning Codes rests solely on the applicant.

Additional Procedures for Exterior Painting and Re-roofing

One of the unit owners acts as the building captain for communication with the board/property manager, the unit owners and the contractor

The building captain should ensure that contractors bidding on the work are licensed, insured, and capable of performing the work. It is suggested that contracts include a clause that requires all products to be installed in accordance with the manufactures's suggestion and recommendations.

As each unit owner is responsible for their unit, individual contracts should be entered into with the contractor.

Each unit owner should fill out and sign an architectural change request, and the building captain should submit them to the property manager for board approval. This also serves as an early warning, if certain unit owners are not willing to repaint or re-roof.

If any unit owner does not agree to paint or re-roof concurrently, notify the board and they will require compliance from the unit owner.
